apparently document.getElementsByTagName('p'); isn't good enough. Perhaps we could add more information in the directions or add some comments around how you would like the student to answer

The method you have used is incorrect. In order to create a paragraph you need to use a createElement
method.
Here's the final version:
var newParagraph = document.createElement('P');
