Would it be semantically correct and accessibility sound if <nav> tag is used in a eBook around a static top banner. It is a decorative element with a <p> number </p>indicating lesson number. There is no links or interactivity. Would <nav> tag still be the best solution in this case scenario?

The HTML <nav> element represents a section of a page whose purpose is to provide navigation links ....
So this doesn't sound like an appropriate use for a <nav> element. Perhaps a <header> would be more suitable.
And what's the issue that this is intended to be a "solution" for?
