I have personally encountered unwanted tracking code in a free theme before, so in a way it wasn't really FREE.

35,800 PointsYour taking a risk anytime you download anything regardless of price. The most common types of bad themes are premium ones that are being pushed for free on unoriginal sites. You are a lot better off downloading a free theme from the WordPress repository since bad themes get removed from there if reported. Just be careful what you download and remember you have the ability to look into the code yourself.
